General Terms & Conditions

These general Terms and Conditions apply to when you, the customer, place an order from Sjöstrand Art by Johanna; ‘’the company’’ or ‘’us.’’

By accepting these Terms and Conditions you confirm that you are at least 18 years old or that you have your trustee’s approval and that you meet the general Terms and Conditions. You also confirm that you have read the information regarding the handling of personal data and cookies and that you have read and approved Squarespace integrity policy, https://www.squarespace.com/privacy, as mentioned before.

We strive to sell our products to multiple countries and jurisdictions, and these terms and conditions have been established with the intent of being global. However, depending on where you live, compulsory legislation may apply. We respect applicable laws and nothing in these Terms and Conditions shall be construed as limiting your statutory rights, if such laws give you greater rights than stated herein.

By accepting these Terms and Conditions, you acknowledge and agree that all orders, purchases and transactions are made exclusively between the Company and the Customer and that Squarespace - as a platform provider - accepts no responsibility for content, interactions or transactions made on Sjöstrand Art by Johanna.

Orders etc.

When you receive an order confirmation from us, it means your order has been accepted and you have entered a purchase agreement. We recommend that you save the order confirmation for any future contact with us. We can refuse an order for various reasons, for example, if you leave incorrect personal data and/or debited with you previously. You can undo your order until we have confirmed it. We will then refund any expenses that you, your account or Credit Card Company have issued for the order. We can cancel an order if the ordered products are sold out. We will then refund any expenses and notify you of equivalent products if available. All ordered products remain our property until we have received full payment for them.

You are responsible for the accuracy and completeness of the personal information you provide to us.

Prices, fees, etc.

The prices quoted on the Website apply to orders that have been posted to the site. All prices are subject to the currency stated on the website and include VAT where stated (depending on where you may be, VAT may not apply to your purchase). Unless otherwise stated on the site, no payment or shipping costs are included and are reported separately. Keep in mind that local fees (such as currency exchange charges, credit or debit card fees, VAT, customs duties, etc.) may occur depending on where you live and your local laws. You are responsible for such fees and cannot get them paid by us.

Special Offers

On some occasions, for certain products, we may offer better terms than those specified in the General Terms, for example, free returns. Such better terms apply only for a limited period of time, until the specific products have expired and may be cancelled by us at any time, and in such case, these terms and conditions apply without modification.

Shipping and delivery

Products in stock usually ship within the number of working days shown on the site. The estimated delivery time for an order is stated in the order confirmation. In case of delays, we will inform you and continue to monitor the order. You can cancel the order if delivery is delayed for more than 30 days and the delay has not occurred due to you.

Depending on the shipping method, you may need to pick up the order from a specific delivery point. You must do so within the time specified on delivery. If you do not get the order in time, a delay fee may be charged from you and the order can be returned to us at your expense. We can also cancel the order if you do not pick it up on time.

Return Policy

You are entitled to cancel your order by notifying us within 14 days of receiving your products. You must then send us a voucher with your name, address and e-mail address, order number and list of products covered, for example, using the form on the Site. Then you must return the products to us at your own expense immediately and within 14 days of sending you the voucher. You are responsible for the shipment of the products during delivery back to us, therefore we recommend that you send them well packed, in good condition and in the original box and/or the packaging.

When you regret an order, we refund the price you paid for the products you return, including shipping costs for your standard delivery (i.e., the cheapest shipping method; you will not be refunded for additional expenses if you chose express delivery or the like). However, from the refundable amount, we may deduct money for the product's value reduction if this has occurred due to your handling being too tiresome in relation to what is required to determine the product's function or characteristic features. In addition, shipping costs will only be refunded if the returned products constitute an entire order, so they will not be refunded if you only return parts of an order. We will issue your refund as soon as possible and within 14 days of receiving your voucher. However, we will hold the refund until we have received the returned products or proof that they have been shipped to us (in the form of a delivery certificate). The refund will be paid using the same payment method you used to pay the returned products unless otherwise agreed.

Your right of withdrawal is not valid for contracts such as:

applies to a service that has been performed completely if you, when you placed your order, approved the performance of the service and found that you would not have any right of withdrawal after the service was executed

applies to goods or services whose price is due to fluctuations in the market that we can not control and which can occur during the period between receiving the product whose purchase you wish to cancel and the time when we were notified that you want to cancel the purchase

apply to goods that have been manufactured according to your instructions or otherwise tailored to you

apply to goods that fall rapidly or have expiration dates

applies to goods with broken packaging that are not suitable for return due to health or hygiene reasons and the packaging has been broken by you

apply to goods which, after delivery, are of their own nature that they can not be separated from other items they have been mixed with

applies to sealed audio or video recordings or sealed computer software and the seal has been broken by you

apply to individual copies of a newspaper or journal

applies to digital content delivered in a way other than physical media, if you have accepted such delivery and determined that you waive your right of withdrawal

applies to cultural events, sports events or similar entertainment activities, food services, catering or similar services, accommodation, transportation of goods or rental of means of transport, where we provide the service on a specific day or during a specific period.

Warranty and Complaints

Certain of our products may be subject to warranty. Information about such warranties is provided on the Website or in these General Terms and Conditions. Order Confirmation is a guarantee certificate. Our warranties cover only manufacturing errors and hence no errors that arise in connection with individual changes to the product's function or appearance after rebuilding, upgrading or other configuration.

You may, within 2 years (or other statutory longer period) after you receive the products, file complaints regarding products that are defective under applicable consumer protection laws. You must then send us a complaint with your name, address and e-mail address, your order number and a list of the products covered by the complaint, for example, using the form on the Site. You must submit your complaint as soon as possible after the defect has been detected. All complaints submitted within two months of the discovery of the defect are counted as submitted in good time.

We will refund you for the defective products in accordance with current consumer protection laws and are responsible for costs incurred in returning the products to us. It is our goal to issue such payments within 30 days of receiving the complaint and stipulating that a refund will be made, but it may take longer depending on the nature of the product. It is also our aim to comply with the guidelines for defective products determined by relevant national consumer protection authorities. The refund will be paid using the same payment method you used to pay the defective products unless otherwise agreed.

Limitation of Liability

Unless local law states otherwise, our liability is limited to direct damage and under no circumstances shall we be held liable for indirect damages such as loss of income or the like.

Intellectual property rights

The site and all its contents are owned by us and our licensors and are protected by intellectual property and marketing laws. This means that trademarks, company names, product names, images and graphics, designs, layouts, and information about products, services and other content may not be copied or used without written approval from us.

Disclaimer

We reserve ourselves for errors in image and typography on the Site, such as defects in product descriptions, technical indications, incorrect pricing or incorrect information regarding a product's stock status. We have the right to correct obvious errors and may change or update information at any time at the Site.

Images on the Site are illustrative only and are not guaranteed representation of the exact number of products you receive if you order, nor the appearance, function or origin of the product are correct.

Changes to the General Terms and Conditions

We may change these Terms and Conditions at any time. We then apply the amended General Terms and Conditions on the Site and they will take effect when you accept them (when you place a new order through the Website or when you visit the Site).

Legal choice and dispute settlement

In case of dispute, we strive to comply with decisions from relevant national consumer protection authorities.

Disputes concerning the interpretation or application of these Terms and Conditions shall be governed and interpreted in accordance with the laws of the country or state in which we conduct our business and shall be non-exclusive judicial review by the court in which we have our seat. "Non-exclusive assessment" means that you can bring a case against us within another jurisdiction, if there is such a right in national law.
